1. Agreement and service provider
These Terms of Service are a binding agreement between the person or organization using NichePro and Multimedia Publishing LLC, which provides the NichePro service. By creating an account, clicking an acceptance control, starting a trial, purchasing a subscription, or using the service, you agree to these Terms and the Privacy and Cookie Policies.
If you use NichePro for a company or another organization, you confirm that you have authority to bind it. In that case, “you” includes that organization. If you do not agree, do not use the service.
Any order form, checkout disclosure, or written enterprise agreement that expressly references these Terms forms part of the agreement. A signed agreement controls only to the extent it expressly conflicts with these Terms.
Back to top2. Eligibility, accounts, and workspaces
- You must be at least 18, or the age of legal majority where you live, and able to enter a binding contract. The service is not directed to children under 13.
- Registration information must be accurate and kept current. You are responsible for credentials, account activity, authorized members, workspace roles, and promptly reporting suspected unauthorized access.
- A workspace owner or administrator may invite, remove, or change the permissions of members. Content and subscription access may remain controlled by the workspace even when an individual member leaves.
- You may not transfer, sell, share outside your organization, or automate access to an account except through functionality or written permission provided by NichePro.
3. Plans, trials, recurring billing, and cancellation
Features, usage limits, billing interval, currency, taxes, trial length, and total price are shown on the pricing or Stripe Checkout page before purchase. Paid plans renew automatically for the displayed monthly or annual interval until cancelled. Stripe processes payment details and may request identity, address, or tax information.
When a trial requires a payment method, the paid subscription begins and Stripe charges the displayed recurring price when the trial ends unless you cancel first. A no-card trial, when offered, ends or changes access according to the trial disclosure and does not create a paid charge without a payment method and affirmative purchase step.
You can manage renewal cancellation through the authenticated subscription settings. Cancellation takes effect at the end of the current paid period unless checkout or mandatory law states otherwise. Deleting an account is not a substitute for checking that workspace subscriptions were cancelled, although the account-deletion flow attempts to schedule cancellation for eligible subscriptions.
Fees are generally non-refundable after a billing period begins to the extent permitted by law. This does not limit mandatory refund, withdrawal, charge-dispute, service-conformity, or other consumer rights. If a payment fails, access may be limited while Stripe retries the payment or the account resolves it.
Back to top4. Consumer safeguards in the EU, Italy, UK, and United States
Nothing in these Terms excludes rights that cannot lawfully be waived. If you are a consumer, mandatory rules of your habitual residence continue to apply, including rules on transparent pricing, unfair terms, digital-service conformity, remedies, and access to competent courts.
EU and Italian consumers generally have 14 days to withdraw from a distance service contract. If you expressly request performance during that period, the provider may be entitled only to a proportionate amount for service already supplied when the legally required information and request were obtained. For digital content not supplied on a tangible medium, the withdrawal right is lost only after the legally required prior express consent and acknowledgement. NichePro does not treat the right as waived where those requirements were not met.
Under EU and Italian consumer law, a digital service must conform to the contract and may carry rights to restoration of conformity, a proportionate price reduction, or termination where statutory conditions are met. Commercial cancellation and refund rules do not replace these remedies.
During the statutory withdrawal period, an authenticated user can submit an online withdrawal statement through the dedicated NichePro withdrawal function. The electronic acknowledgement confirms receipt of the statement; it does not promise an automatic refund or predetermine eligibility, amounts, service already supplied, or other consequences under applicable law.
For U.S. consumers, recurring terms and cancellation methods are presented before purchase and in account settings. California and other state automatic-renewal protections, cancellation rights, and required acknowledgements apply when their statutory conditions are met. These Terms do not impose mandatory arbitration, a class-action waiver, or a choice of court that overrides a consumer's non-waivable rights.
5. Acceptable use
Use NichePro only for lawful publishing research, analysis, and content-development activities. You are responsible for how you use research and generated outputs and for complying with Amazon, KDP, advertising, intellectual-property, consumer, privacy, and platform rules that apply to your activity.
- Do not infringe intellectual-property, privacy, publicity, contractual, or other rights, or upload content you are not authorized to process.
- Do not use the service for fraud, deceptive reviews, manipulation, harassment, discrimination, malware, unlawful surveillance, spam, or illegal goods or services.
- Do not bypass plan limits, access controls, rate limits, consent controls, or security measures; probe vulnerabilities; disrupt the service; or access another user's data.
- Do not resell raw access, scrape the NichePro application, reverse engineer non-public components, or use automated agents against the service except through an authorized interface or written permission.
- Do not present estimates or generated content as guaranteed earnings, official Amazon guidance, legal advice, or verified facts without independent review.
6. Your content and permissions
As between you and NichePro, you retain rights you hold in inputs, project content, edits, and selections. You grant Multimedia Publishing LLC and its processors a limited, non-exclusive permission to host, copy, transform, transmit, and display that content only as needed to operate, secure, support, and improve the requested service, comply with law, and enforce these Terms.
You represent that you have the rights and lawful basis needed for submitted content. Do not submit confidential information governed by professional secrecy, protected health information, card credentials, government identifiers, or personal data that is unnecessary for the publishing task.
Workspace content may be visible to members according to their roles. Keep independent copies of material needed for publication; NichePro is a workflow tool, not an archival or records-retention service.
Back to top7. AI output, estimates, and publishing decisions
NichePro provides research signals, calculations, estimates, and AI-assisted drafts. Outputs may contain errors, omissions, invented facts, third-party similarities, biased assumptions, or outdated marketplace data. Royalties, sales, rankings, competition, and advertising outcomes depend on external factors and are not guaranteed.
You must independently review titles, subtitles, descriptions, keywords, covers, tables of contents, claims, translations, trademarks, copyrights, citations, and compliance before publication. NichePro does not provide legal, tax, accounting, investment, medical, or professional publishing advice and does not promise a bestseller, approval by Amazon, or any minimum revenue.
To the extent permitted by applicable law, NichePro does not claim ownership of generated output solely because it was generated by the service. The law may not recognize exclusive rights in some AI-generated material, and similar output may be generated for others. You remain responsible for selection and use.
Back to top8. NichePro intellectual property
Multimedia Publishing LLC and its licensors own NichePro software, interface, branding, documentation, databases, selection and arrangement of data, and all related intellectual-property rights, excluding your content and third-party material. Subject to these Terms, you receive a limited, revocable, non-exclusive, non-transferable right to use the service during the applicable access period.
Feedback may be used without restriction or payment, provided it does not identify you publicly without permission. NichePro and its logos may not be used to imply sponsorship, affiliation, or endorsement without written authorization.
Back to top9. Third-party services and marketplace independence
NichePro integrates with or relies on services including Supabase, Stripe, OpenAI, Vercel, Render, Resend, Keepa, DataForSEO, ScraperAPI, Bright Data, and public Amazon pages. Their availability, data, and terms can change without NichePro's control. A link or integration does not make NichePro responsible for a third party's service.
NichePro is independent and is not Amazon, Kindle Direct Publishing, or an Amazon affiliate unless a specific page expressly states a separate referral relationship. Amazon trademarks belong to their owners. You are solely responsible for your KDP account and compliance with marketplace policies.
Back to top10. Availability, limits, and changes
We aim to keep NichePro available but do not promise uninterrupted or error-free operation. Maintenance, provider outages, rate limits, marketplace changes, security events, or force-majeure conditions may delay or remove a feature or data source.
We may improve, replace, or discontinue features and adjust reasonable usage or abuse-prevention limits. If a change materially reduces a paid plan during its current term, mandatory consumer remedies and any specific notice or migration commitment provided with that plan continue to apply.
Back to top11. Suspension and termination
We may limit or suspend access when reasonably necessary to address a security risk, unlawful activity, non-payment, material breach, excessive automated use, or harm to users, providers, or the service. When appropriate, we will give notice and an opportunity to remedy before termination, unless immediate action is needed or prohibited by law.
You may stop using NichePro, cancel renewal, and request account deletion. Termination does not erase payment obligations already accrued or provisions that by nature survive, including ownership, payment, disclaimers, liability limits, dispute rules, and lawful retention.
Back to top12. Disclaimers
To the maximum extent permitted by law, NichePro is provided “as is” and “as available.” Multimedia Publishing LLC disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. This disclaimer does not apply to warranties, conformity duties, or remedies that cannot be excluded for consumers.
Marketplace data and third-party results may be delayed, incomplete, estimated, or unavailable. No statement in the service is a guarantee of publication acceptance, ranking, demand, sales, royalties, profitability, or legal clearance.
Back to top13. Liability and indemnity
To the maximum extent permitted by law, Multimedia Publishing LLC is not liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or for loss of profits, revenue, goodwill, data, or business opportunity arising from the service or third-party platforms. For claims that may lawfully be capped, aggregate liability will not exceed the greater of the amount you paid for NichePro in the 12 months before the event or USD 100.
The exclusions and cap do not apply where prohibited, including liability that cannot be limited for fraud, willful misconduct, gross negligence, death or personal injury, statutory product liability, breach of data-protection duties, or mandatory consumer remedies. Some U.S. states, including California, do not permit certain exclusions, so they apply only to the extent allowed there.
If you use NichePro for business purposes, you will defend and indemnify Multimedia Publishing LLC against third-party claims caused by your unlawful content, infringement, misuse, or material breach, except to the extent the claim was caused by NichePro. This business indemnity does not apply to consumers where prohibited.
Back to top14. Applicable law and disputes
The operator's formation jurisdiction and any selected governing law or forum are displayed only when legally configured or stated in a separate signed agreement. These Terms do not invent a venue. In the absence of a valid selection, applicable conflict-of-law and jurisdiction rules determine the law and court.
Before filing a claim, the parties should attempt in good faith to resolve it using the legal contact shown on this page. This informal step does not shorten a limitation period or prevent urgent relief. Consumers may use courts and public complaint or alternative-dispute channels available under mandatory local law.
For EU and Italian consumers, any choice of law cannot deprive you of mandatory protections of your habitual residence, and proceedings may be brought in the courts available under applicable consumer-jurisdiction rules. No mandatory arbitration or class-action waiver is imposed by these Terms.
Back to top15. Changes and contact
We may update these Terms for legal, security, provider, or service changes. Material changes will be notified through the service, email, or another appropriate channel with advance notice where required. Changes do not retroactively remove accrued rights. Continuing to use the service after the effective date constitutes acceptance only where permitted by law.
Questions or legal notices should use the provider details shown at the top of this page when configured. If the deployment shows a legal-configuration warning instead of complete contact and registration information, it is not ready to rely on these Terms for public launch.
